By accessing or using Scoop ("Service," "we," "our," or "us"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use our Service.

We reserve the right to update these Terms at any time. We will notify you of material changes by posting the new Terms on this page and updating the "Last Updated" date. Your continued use of the Service after changes constitutes acceptance of the revised Terms.

2. Description of Service

Scoop is an open source web application that manages and delivers training content in a SCORM package library. We provide the Service on an "as is" and "as available" basis.

3. User Accounts

Account Creation

To access certain features, you may need to create an account. You must:

  • Provide accurate, current, and complete information
  • Maintain and promptly update your account information
  • Maintain the security of your password and account
  • Accept responsibility for all activities under your account
  • Notify us immediately of any unauthorized use

Account Termination

We reserve the right to suspend or terminate accounts that:

  • Remain inactive for extended periods
  • Engage in fraudulent or illegal activities
  • Harm other users or the Service

4. Acceptable Use Policy

  • Your User Content does not infringe any third-party rights
  • Your User Content complies with these Terms and all applicable laws

Content Removal

We reserve the right (but have no obligation) to:

  • Remove or refuse any User Content at our sole discretion
  • Remove User Content that violates these Terms or applicable laws
  • Preserve User Content when required by law or legal process

6. Open Source License

The source code for this application is available under MIT License at https://github.com/openscorm/scoop. This license applies to the source code only and does not extend to:

  • User Content
  • Our trademarks, logos, or branding
  • Third-party services or content integrated with the Service

7. Intellectual Property

Our Property

The Service, excluding User Content and open source components, including its original content, features, and functionality, is owned by us and protected by intellectual property laws.

Feedback

Any feedback, suggestions, or ideas you provide about the Service become our property and may be used without compensation or attribution to you.

8. Third-Party Services and Content

The Service may contain links to or integrate with third-party websites, services, or content. We are not responsible for:

  • The availability or accuracy of third-party services
  • The content, products, or services on third-party websites
  • Privacy practices of third parties

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY:

  • INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
  • LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES
  • DAMAGES RESULTING FROM:
    • Your use or inability to use the Service

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID US IN THE PAST TWELVE MONTHS, OR $100 USD IF YOU HAVE NOT PAID US ANYTHING.

You agree to defend, indemnify, and hold harmless Scoop, its operators, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorney's fees) arising from:

  • Your use of the Service
  • Your User Content
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Any harm caused to other users

Force Majeure

We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control.

16. Open Source Instance Operators

If you operate your own instance of this open source application:

  • These Terms do not apply to your instance
  • You are responsible for creating your own terms of service
  • We are not liable for any third-party instances
  • Your use of our source code is governed by the applicable open source license

For users under 18

If you are under 18, you may only use the Service with involvement of a parent or guardian.
